Terms of Service

1. Acceptance of these terms

By creating an account or using Pace-N, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Pace-N. These Terms form a legally binding agreement between you and Gaatur, the operator of Pace-N (contact: support@gaatur.se).

You must be at least 13 years old to use Pace-N. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. What Pace-N is

Pace-N is a fitness accountability application that lets you log workouts, set goals, join groups with friends, and share progress. Pace-N is provided as-is during a beta period and features may change.

Pace-N is not a medical application. Nothing in the app constitutes medical advice, diagnosis, or treatment. Consult a qualified health professional before starting any fitness programme.

3. Your account

You sign in with your Google account. You are responsible for keeping your account secure and for all activity that occurs under your account.

You agree to provide accurate information during onboarding and to keep it up to date. You may only create one account per person.

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

4. Acceptable use

You agree NOT to use Pace-N to:

  • Post content that is unlawful, abusive, harassing, defamatory, or discriminatory
  • Impersonate another person or falsely represent your identity
  • Share false or misleading information about your workouts or performance
  • Attempt to gain unauthorised access to other users' accounts or data
  • Use automated scripts, bots, or tools to interact with the service
  • Attempt to reverse-engineer, copy, or replicate the service
  • Violate any applicable law or regulation

We may remove content that violates these rules and may suspend your account without notice.

5. Content you post

You retain ownership of any content you post to Pace-N — your workout notes, comments, and messages. By posting content, you grant Gaatur a non-exclusive, worldwide, royalty-free licence to store, display, and deliver that content to other users as part of providing the service.

You are solely responsible for the content you post. Do not post anything you do not have the right to share.

GPS route data you record is stored solely for your own use and is never shared in the public feed. You may delete your GPS routes at any time by deleting the associated workout session or your account.

6. Groups

Groups are private by default and accessible only via invite code. Group admins are responsible for the conduct of members in their group. If a group violates these Terms, we may remove the group and its content.

You can leave a group at any time from your profile page. If you are the sole admin of a group with other members, you must transfer the admin role before leaving.

7. Service availability

Pace-N is currently in beta. We do not guarantee that the service will be available at all times or that it will be error-free. We may change, suspend, or discontinue features or the entire service at any time.

We will make reasonable efforts to notify you of planned downtime or significant changes through the app or by email.

8. Intellectual property

Pace-N, its logo, design, and software are owned by Gaatur. You may not copy, modify, or redistribute any part of the service without our written permission.

9. Limitation of liability

To the fullest extent permitted by law, Gaatur shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use Pace-N, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of Pace-N shall not exceed the amount you have paid to us in the 12 months preceding the claim. Since Pace-N is currently free, this limit is zero.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Governing law and disputes

These Terms are governed by Norwegian law. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Norway.

If you are a consumer in the EEA, you may also be entitled to bring a dispute before the consumer protection body in your country of residence.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. If the changes are material, we will notify you through the app or by email.

Continued use of Pace-N after updated Terms are posted constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using Pace-N and delete your account.
